These terms govern the public agency website only. They do not replace a signed proposal, statement of work, invoice, service agreement or other project-specific terms.
1. Acceptance of these terms
These Terms of Use apply to the NSheth agency website at nsheth.in. NSheth is a small digital agency operated by Nityam Sheth in India.
By accessing or using this website, you agree to these terms and the Privacy Policy. If you do not agree, please do not use the website or submit information through it.
2. What this website provides
The website describes NSheth’s capabilities, process and agency model, and provides ways to start a conversation. Its content is general information, not professional legal, financial, tax or other regulated advice.
We may update, remove or reorganise website content and features without notice. We try to keep published information useful and accurate, but do not promise that every page will always be complete, current or error-free.
3. Enquiries and project engagements
Submitting the contact form, sending a WhatsApp message or emailing us is an invitation to discuss possible work. It does not require either party to proceed and does not itself create a client relationship, contract, exclusivity obligation, quote or promise of availability.
If we agree to work together, the applicable proposal, scope, estimate, invoice, statement of work or written agreement will define matters such as:
- deliverables, responsibilities and assumptions;
- fees, taxes, deposits, payment dates and approved expenses;
- timeline, dependencies, reviews and acceptance;
- change requests and work outside the agreed scope;
- third-party products, licences, hosting and subscriptions;
- intellectual-property ownership and portfolio permissions;
- confidentiality, support, maintenance, cancellation and refunds; and
- warranties, liability limits and dispute arrangements.
If a project-specific agreement conflicts with these website terms, the project-specific agreement controls for that engagement.
4. Website content and ownership
Unless stated otherwise, the website’s design, copy, graphics, code, brand elements and original materials are owned by or licensed to NSheth and are protected by applicable intellectual-property laws.
You may view and use the website for ordinary personal or business evaluation. You may link to public pages in a fair and lawful way. You may not copy, republish, sell, license, scrape, frame, remove attribution from, or create misleading derivatives of substantial website content without written permission or another lawful basis.
Third-party names, logos, software and linked services remain the property of their respective owners. Their appearance does not imply sponsorship or endorsement.
5. Acceptable use
You agree not to:
- use the website for unlawful, fraudulent, abusive or deceptive activity;
- submit malicious code, spam, false contact details or content that infringes another person’s rights;
- probe, bypass or interfere with website security, rate limits, availability or normal operation;
- access restricted files, systems or data without authorisation;
- misrepresent your relationship with NSheth; or
- use automated means in a way that creates unreasonable load or violates applicable law.
We may block submissions or access where reasonably necessary to protect the website, our systems, other users or legal rights.
6. Third-party links and services
The website links to services such as WhatsApp, LinkedIn, GitHub and the separate Nityam personal site. We do not control third-party availability, security, content, terms or privacy practices. Opening a third-party link is at your discretion and subject to that provider’s policies.
Any third-party product or service used in a client project—including domains, hosting, payment providers, plugins, APIs and software subscriptions—is governed by the applicable provider’s terms and the project-specific agreement.
7. Availability and disclaimers
The website is provided on an “as available” basis. To the extent permitted by law, we do not give implied guarantees that it will be uninterrupted, error-free, secure, suitable for a particular purpose or compatible with every browser, device or third-party service.
Examples, descriptions and general statements on the website are not guarantees of a particular result. Project outcomes depend on scope, client inputs, third-party systems, market conditions and other factors addressed in the relevant project agreement.
8. Limitation of liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
To the extent permitted by law, NSheth will not be liable for indirect, incidental, special or consequential loss arising solely from use of, inability to use, or reliance on this public website or a third-party link. Liability connected with paid services is governed by the applicable project-specific agreement.
9. Changes, governing law and contact
We may update these terms when the website, our services or applicable law changes. The current version and last-updated date will appear on this page. Continued use after an update means the revised terms apply from their effective date.
These website terms are governed by the laws of India. Courts with jurisdiction over NSheth’s principal place of business in India will have jurisdiction, subject to any mandatory rights or dispute process that applies under law.
